1. Eligibility

To use the App you must be at least 13 years old (or the minimum age in your jurisdiction). By using Listimo you represent and warrant that you meet this eligibility requirement and that you have legal capacity to enter into these Terms.

2. Account Registration

Some features require an account. You may register using an email address or a third-party authentication provider (such as Apple or Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Acceptable Use

You agree to use the App lawfully and not to:

• • Upload, post, or share content that is illegal, abusive, defamatory, infringing, pornographic, or otherwise objectionable;

• • Attempt to access restricted areas of the App or interfere with its operation;

• • Reverse engineer, decompile, or otherwise attempt to extract source code from the App;

• • Use automated means (bots, scrapers) to access the App without our prior written consent.

We may suspend or terminate accounts that violate these rules.

4. Content Ownership & License

Your Content

You retain ownership of content you create or upload (lists, tasks/items, chat messages, attachments). By submitting content, you grant Listimo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), and display such content only as necessary to provide and improve the App.

Shared Content

When you share lists or tasks with other users, those collaborators may view, copy, and interact with the shared content. You are responsible for what you share.

Our Rights

All Listimo trademarks, logos, design, and app code are owned by Listimo or our licensors. You agree not to copy or create derivative works from our intellectual property.

5. Premium Subscriptions & Payments

Listimo offers a Free plan and optional paid Premium subscriptions that unlock additional features. Subscriptions are billed via third-party app stores or payment processors (e.g., Apple, Google, RevenueCat). The terms of billing, renewal, and refunds are governed by the app store or payment processor you used to subscribe.

Note: We do not store full payment card numbers. We receive confirmation of subscription status and related metadata for provisioning premium features.

6. Suspension & Termination

We may suspend or terminate your account and access to the App for violations of these Terms, suspected fraud, legal requests, or if we discontinue the App. Termination does not limit our ability to pursue other remedies available by law or equity.

7. Data & Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use personal data. By using the App you consent to those practices.

8. Disclaimers

The App is provided "as is" and "as available." Listimo disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Listimo, its affiliates, officers, employees, or agents be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, data loss, or business interruption) arising from your use of the App.

Our aggregate liability for direct damages arising out of or related to these Terms will not exceed the greater of (a) the total amount you paid for Listimo Premium subscriptions in the 12 months prior to the claim, or (b) $50. Some jurisdictions do not allow limitations of liability, so these limits may not apply to you.

10. Indemnification

You agree to indemnify and hold Listimo and its officers, directors, employees and agents harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, or your infringement of third-party rights.

11. Changes to the App & Terms

We may modify the App, subscription plans, features, pricing, or these Terms at any time. When changes are material, we will provide reasonable notice (for example, via email or in-app notification). Continued use after notice constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Insert Jurisdiction — e.g., State of Georgia, USA], without regard to conflict of law rules. You agree that disputes will be resolved in the state and federal courts located in that jurisdiction, and you consent to personal jurisdiction there. If you live in a jurisdiction that requires different dispute resolution terms, those local rules will apply to you.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by Listimo, constitute the entire agreement between you and Listimo regarding the App, superseding any prior agreements.

16. Additional Provisions

16.1 Third-Party Services

The App may integrate with third-party services (such as cloud providers, analytics platforms, or payment processors). Your use of those services may be subject to separate terms and privacy policies.

16.2 Promotional Messages

With your consent, we may send promotional emails. You may opt out of promotional messages at any time through account settings or by contacting support.
